AuctionShed (auctionshed.nl, auctionshed.be, auctionshed.com, auctionshed.fr) is operated by AuctionShed, registered as natuurlijk persoon under business number 1018946792 (“AuctionShed”, “we”, “our”, “us”).
AuctionShed provides an online marketplace where independent sellers can offer goods via auction to independent buyers. AuctionShed is not the seller of any item. All contracts are concluded directly between buyer and seller.
By registering, bidding, or selling on AuctionShed, you accept and agree to these Terms & Conditions.
1.1 AuctionShed acts only as a facilitator. We provide the technical infrastructure for auctions, payment handling, and dispute resolution.
1.2 AuctionShed does not own or sell the items listed. The sales contract is strictly between buyer and seller.
1.3 AuctionShed may operate under multiple domains, including veilhuis.nl, veilhuis.be, encheria.be, and encheria.fr, and names including Veilhuis and Encheria.
1.4 Approval of listings: Every item is reviewed and approved by a human moderator before going live. AuctionShed reserves the right to reject or remove any listing at its sole discretion. Approval of a listing does not constitute verification of authenticity, legality, ownership, or accuracy. AuctionShed does not guarantee the correctness of any approved listing.
1.5 AuctionShed may suspend auctions, modify features, suspend or terminate a user account only where this is reasonably necessary and proportionate, including but not limited to the following circumstances:
failure to pay amounts due following a winning bid;
breach of these Terms & Conditions by the buyer or seller;
repeated misuse of the platform or abuse of the bidding system;
provision of false, misleading or unlawful information;
compliance with applicable laws, regulations, court orders or requests from competent authorities;
prevention of fraud, security risks or technical abuse of the platform.
Suspension or termination is not applied arbitrarily and is limited to what is necessary to protect the integrity, legal compliance and proper functioning of the AuctionShed marketplace.
2.1 Users must be at least 18 years old and legally capable of entering binding contracts.
2.2 Users are responsible for providing accurate registration details, including valid contact and payment information.
2.3 Users must keep their account credentials secure. AuctionShed is not liable for unauthorized use of accounts.
2.4 Users may not create multiple accounts to bypass restrictions.
2.5 AuctionShed may suspend or terminate accounts suspected of fraud, abuse, or violation of these Terms.
3.1 Sellers are fully responsible for the accuracy and truthfulness of item descriptions, dimensions, weights, and authenticity. Misrepresentation may result in additional costs or suspension.
3.2 Clear photographs with a neutral background must be uploaded. Photos form part of the item description.
3.3 All dents, scratches, damages, or restorations must be clearly photographed and described.
3.4 Branded items, gold, silver, or other valuables must be accompanied by an original purchase receipt, certificate, or expert authenticity report.
3.5 All auctions start at €1 and run for 7 days, unless otherwise determined by AuctionShed.
3.6 Sellers are responsible for packaging, shipping, and insurance. Incorrect weight or dimension entries may lead to additional invoices.
3.7 Sellers must ship using the shipping method selected at checkout. Upgrades (e.g. pickup point → home delivery) are permitted; downgrades are not.
3.8 Risk remains with the seller until confirmed delivery.
3.9 Sellers must upload only their own original photos and descriptions. Copyright infringement is strictly prohibited.
3.10 By uploading photos and descriptions, sellers grant AuctionShed a free, worldwide, non-exclusive licence to use such content for marketing and platform purposes.
3.11 If a seller fails to ship, misrepresents items, or uploads unlawful content, AuctionShed may suspend the account, withhold payouts, and charge penalties.
3.12 Sellers are solely responsible for complying with tax and VAT obligations in their jurisdiction. AuctionShed does not provide tax advice.
4.1 Every bid placed on the platform is legally binding.
4.2 The highest bidder at auction close is the winner and must complete payment.
4.3 Buyers must pay within 7 days of auction close.

4.6 If a buyer initiates a chargeback or payment reversal, AuctionShed may recover the disputed amount from the buyer’s future payments or initiate legal action.
4.7 No automatic right of withdrawal. Auctions on the Platform are binding. Statutory consumer withdrawal rights may not apply to auction sales under applicable law. Where such rights do apply, they are exercised exclusively against the seller, not AuctionShed.
5.1 Buyers pay the winning bid plus applicable shipping costs.
5.2 AuctionShed charges a commission of 5% + €0.99 per transaction, VAT included where applicable.

5.6 Payment processing
Payments on the Platform are processed by third-party payment service providers, including Stripe. Payment processing services are provided subject to the terms and conditions of such providers. AuctionShed does not control and is not responsible for the operation, availability, or compliance of third-party payment services.
6.1 After delivery, a 48-hour cooldown period applies.

6.4 AuctionShed provides an internal messaging and dispute resolution system to facilitate communication between buyers and sellers. Users are required to make reasonable efforts to resolve disputes directly through this system.
6.5 AuctionShed may review disputes for the sole purpose of administering payments processed through third-party payment providers such as Stripe, including releasing, withholding or refunding funds where appropriate.
AuctionShed does not act as an arbitrator of ownership, authenticity or contractual performance between buyers and sellers. Any decision taken by AuctionShed within the platform does not affect the parties’ statutory rights to pursue claims before competent courts or authorities.
6.6 AuctionShed is not obligated to participate in disputes beyond its internal resolution process, except where required by law or competent authorities.
6.7 AuctionShed may request evidence from buyers or sellers, including photographs, shipping proof, or correspondence. Failure to provide sufficient evidence may result in a decision against the non-cooperating party.

7.3 If AuctionShed is found liable for any reason, liability is strictly limited to the total commission fees paid by the user concerned, except in cases of fraud, willful misconduct, gross negligence, or where liability cannot be limited under applicable law.

8.3 AuctionShed is not liable for any failure or delay caused by circumstances beyond its reasonable control, including strikes, natural disasters, cyber-attacks, regulatory changes, or technical failures (force majeure).
AuctionShed operates exclusively as an online marketplace and is not the seller of items offered on the platform. All sales contracts are concluded directly between the buyer and the seller.
Sellers are solely responsible for complying with applicable consumer protection laws, including obligations relating to product conformity, delivery, guarantees, withdrawal rights (where applicable), and refunds.
Buyers acknowledge that statutory consumer rights may vary depending on whether the seller acts in a professional or private capacity, as defined under applicable law.
AuctionShed does not provide legal advice regarding consumer rights but requires sellers to provide clear and accurate information prior to the conclusion of any transaction.
10.1 These Terms are governed exclusively by Belgian law.
10.2 Any disputes between AuctionShed and users fall under the jurisdiction of the courts of the Walloon Region, Belgium.
10.3 Disputes between buyer and seller must be resolved directly between those parties; AuctionShed may assist but is not a contractual party. Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship between AuctionShed and any user. Sellers act solely on their own behalf and not in the name or on behalf of AuctionShed.
10.4 AuctionShed may update or amend these Terms at any time. Continued use of the platform constitutes acceptance of the latest version.
10.5 If any clause of these Terms is found invalid, the remainder shall continue in full force.
10.6 In case of conflict between translations, the English version prevails.

These Terms constitute the entire agreement between AuctionShed and the user concerning use of the Platform and supersede any prior agreements or representations.
